<p>Although most brokers enter into written listing agreements or written fee agreements, Maryland courts find that oral agreements are enforceable as well. The employment of a broker for specified services may be implied from the conduct of parties, or the owner may ratify the acts of a party acting as a broker, thereby confirming the broker&#8217;s expected oral employment.</p>
<p>Commissions, in those instances, are imposed under the broker laws, which prescribe the payment terms to be used in the absence of a written agreement to the contrary. Therefore, it is strongly recommended that anyone who wants to hire or use a licensed broker for a real estate transaction in Maryland, or who is concerned about when and whether fees accrue, clarify the listing agreement or fee terms in writing.</p>
<p>A listing agreement should specify what the broker is to be paid for, and when the commission is deemed earned: for instance, in a sales listing agreement, the commission should be stated to be earned when the sale closes, and in a leasing listing agreement, to be earned when the tenant actually occupies the space and first pays rent.</p>
<p>The listing agreement should also detail the broker&#8217;s obligations to the owner, such as confirmation that the broker is licensed, the broker&#8217;s use of its best efforts on the owner&#8217;s behalf, the level of ability and training the broker&#8217;s employees assigned for the project, whether some specific employee will be assigned, and periodic reporting requirements.</p>

Processors perform a very critical function in the mortgage process.</p>
<p>It is important that you provide all the documentation requested to your processor or loan officer, so that they may submit a complete package to be underwritten.</p>
<p>Once all the required documentation is assembled, it will be sent by courier or sometimes faxed to be underwritten. The Underwriter&#8217;s job is to review and make a loan decision based on the information and documentation provided and make certain that it is within the underwriting guidelines set up by the lender.</p>
<p>Usually there will be some conditions to be met for a &#8220;final&#8221; loan approval. It is important to remember the complexity of this process and not be frustrated or angry if the processor or loan officer ask you for additional information, sometimes just days before closing is scheduled. Talk to sports fans in the area and they will tell you that the hot new DC real estate is the new Nationals Park in the Southeast section of the city. But the overall reality is that there&#8217;s a whole lot more to DC real estate than simply historic and cultural centers and tourist destinations.</p>
<p>Whether you&#8217;re visiting the Washington, DC area or you already live in the metro DC area, chances are good that you have a sense that DC real estate has a lot to offer. You can&#8217;t ride the Metro without seeing dozens of advertisements announcing the construction of new condominium complexes and luxury living in the city. If you&#8217;ve been finding yourself eyeing these advertisements - as well as the real estate section of The Washington Post - then chances are good that you&#8217;re starting to think about DC real estate a bit more seriously.</p>
